America's Service Commissions Statement on Preliminary Injunction in AmeriCorps Court Case

America’s Service Commissions (ASC) is grateful for the preliminary injunction issued today in the lawsuit led by a group of Attorneys General and Governors (Maryland et al v CNCS), challenging the AmeriCorps grant terminations and AmeriCorps NCCC demobilization that took place in April. The preliminary injunction instructs the AmeriCorps agency to restore the terminated grants and members in the 24 states and the District of Columbia that are parties in the lawsuit and to restore the AmeriCorps NCCC program nationally. While we are thankful for the harm that may be mitigated in those states, we are disappointed that the preliminary injunction will not alleviate harm in the remaining impacted 29 states and territories, leaving tens of thousands of AmeriCorps members and program staff, not to mention community members, without remedy. We urge the court in this and other pending lawsuits on these matters to provide relief to all impacted states and territories.

We encourage our service champions to continue contacting your Members of Congress to express your support for AmeriCorps. We also ask you to consider donating to our National AmeriCorps Member Emergency Fund, which financially supports AmeriCorps members impacted by the recent grant terminations, as the need for financial support currently exceeds the available funds.
